This is a policy template for the Truth in Lending Act (TILA) and its implementing regulation, Regulation Z, for mortgage lenders that I created in 2021. This is a general template that can be adapted to any mortgage program.

About This Policy
- Purpose:
[Company Name]has established this policy to ensure compliance with the applicable mortgage lending provisions of the Truth in Lending Act (TILA) and its implementing regulation, Regulation Z. - Summary: The Truth in Lending Act (TILA) promotes the informed use of consumer credit by disclosing the cost of credit and actual terms to consumers in a way that is easily understood.
- Policy Statement: It is the policy of

Definitions
- Adjustable Rate Mortgage (ARM): A closed-end consumer credit transaction secured by a dwelling in which the annual percentage rate (APR) may increase after consummation.
- Amount Financed: The amount of credit extended. It is calculated by determining the principal loan amount or cash price (subtracting downpayment), adding other amounts financed by the creditor not part of the finance charge, and subtracting any prepaid finance charge.
- Application Date: An application is the submission of a consumer’s financial information to obtain an extension of credit.
- Business Day - General: A day on which the creditor’s offices are open to the public for carrying on substantially all of its business functions.
- Business Day - Specific: All calendar days except Sundays and legal federal public holidays.
- Closed-End Credit: Consumer credit other than “open-end credit”.
- Consumer: A natural person to whom consumer credit is offered or extended. For purposes of rescission, it includes a natural person in whose principal dwelling a security interest is retained or acquired, if that person’s ownership interest is subject to the security interest.
- Consumer Credit: Credit offered or extended to a consumer primarily for personal, family, or household purposes.
- Open-End Credit: Consumer credit under a plan where the creditor reasonably contemplates repeated transactions, may impose a finance charge from time to time on an outstanding unpaid balance, and generally makes credit available up to a limit as outstanding balances are repaid.
- Payment Schedule: The number, amounts, and timing of payments scheduled to repay the obligation.
- Residential Mortgage Transaction: A transaction in which a mortgage, deed of trust, or equivalent consensual security interest is created or retained in the consumer’s principal dwelling to finance the acquisition or initial construction of that dwelling.
- Total of Payments: The total the consumer will have paid after making all payments of principal, interest, mortgage insurance, and loan costs, as scheduled.
Finance Charge and Annual Percentage Rate (APR)
Finance Charge
- Policy: It is the policy of
[Company Name]to accurately disclose the finance charge, and all disclosures based on the finance charge, as defined in, and as required by, Regulation Z. - Definition: Expressed as a dollar amount, it is the total amount of interest and loan charges the borrower would pay over the entire life of the mortgage loan, including certain charges paid by or imposed on the consumer as an incident to or condition of the extension of credit.
- Prepaid Finance Charge: Any finance charge paid at or before consummation or withheld from the proceeds of the credit at any time.
- Tolerance: For closed-end mortgage loans, the disclosed finance charge is considered accurate if it is not understated by more than $100. To mitigate the risk of extending the rescission period in cases where foreclosure has been initiated,
[Company Name]considers the Finance Charge accurate if it is understated by no more than $35 on a rescindable transaction.
Annual Percentage Rate (APR)
- Policy: It is the policy of
[Company Name]to accurately disclose the annual percentage rate as defined in, and as required by, Regulation Z. - Definition: A measure of the cost of credit, expressed as a nominal yearly rate. It must be disclosed as a single rate only.
- Tolerance: For regular mortgage loans, the disclosed APR is considered accurate if it is not more than 0.125 percentage point above or below the correctly calculated APR.
Disclosures
General Disclosure Requirements
- Policy: It is the policy of
[Company Name]to make all disclosures required by Regulation Z clearly and conspicuously in writing, in a form that the consumer may keep. Disclosures may be provided electronically, subject to E-Sign Act compliance.
TILA-RESPA Integrated Disclosures (TRID)
- Policy:
[Company Name]must provide consumers with clear, integrated disclosures regarding the costs and terms of their mortgage loan. - Implementation Details: * Loan Estimate: Must be delivered or placed in the mail no later than the third specific business day after receiving the consumer’s application.
- Closing Disclosure: Must be provided to the consumer at least three specific business days before consummation of the loan.

Variable-Rate (ARM) Disclosures
- Policy: For variable-rate mortgage transactions secured by the consumer’s principal dwelling,
[Company Name]will provide the “Consumer Handbook on Adjustable Rate Mortgages” booklet and an “Adjustable-Rate Mortgage” disclosure based on Appendix X of Regulation Z. These must be provided at the time an application form is provided or before the consumer pays a non-refundable fee, whichever is earlier.
Special Information Booklet
- Policy: Not later than three business days after receiving a consumer’s application for a mortgage loan to purchase a one-to-four family residential property,

Mortgage Servicing & Post-Consummation Rules
Periodic Statements
- Policy:
[Company Name](or its designated subservicer) will provide consumers with clear and regular periodic statements for residential mortgage loans in accordance with the timing and content requirements of Regulation Z.
Prompt Crediting and Payoff Statements
- Policy: Mortgage payments must be credited to the consumer’s account on the date of receipt. Additionally, accurate payoff statements must be provided within a reasonable time, not to exceed seven business days after receiving a written request from the consumer or authorized representative.
Mortgage Transfer Disclosures
- Policy: If
[Company Name]acquires or purchases the legal title to a mortgage loan, a Notice of New Creditor must be mailed or delivered to the borrower within 30 days of the acquisition, detailing the transfer of ownership.
Additional Regulatory Requirements
Right of Rescission
- Policy: In a credit transaction in which a security interest is or will be retained or acquired in a consumer’s principal dwelling (such as a refinance or home equity loan), each consumer whose ownership interest is subject to the security interest shall have the right to rescind the transaction.
- Implementation Details: The consumer may exercise the right to rescind until midnight of the third business day following consummation, delivery of the notice of right to rescind, or delivery of all material disclosures, whichever occurs last. Refer to the
[Company Name]Right of Rescission policy for detailed handling procedures.
High-Cost Mortgages
- Policy: It is the policy of
[Company Name]to not make high-cost loans as defined in Regulation Z. A high-cost mortgage includes loans where the APR exceeds the APOR by more than 6.5% for a first-lien transaction, total points and fees exceed 5% of the total loan amount (for loans $20,000 or more), or prepayment penalties exceed certain thresholds.
Higher-Priced Mortgage Loans
- Policy: It is the policy of
[Company Name]to comply with all requirements for higher-priced mortgage loans under Regulation Z. - Definition: A closed-end consumer credit transaction secured by the consumer’s principal dwelling with an APR that exceeds the average prime offer rate by 1.5% or more for conforming first liens, 2.5% or more for jumbo first liens, or 3.5% or more for subordinate liens.
- Escrow Accounts: For higher-priced mortgage loans,
[Company Name]must establish an escrow account before consummation for payment of taxes and property insurance. - Appraisal Requirements: Since qualified mortgages are exempt from higher-priced mortgage appraisal requirements, and since
[Company Name]limits loan origination to qualified mortgages, Regulation Z’s appraisal requirements for higher-priced mortgage loans are not applicable.

Administrative and Governance Requirements
Record Retention
- Policy:
[Company Name]will retain evidence of compliance with Regulation Z to demonstrate adherence to all disclosure and procedural requirements. - Implementation Details: * General TILA disclosures must be retained for 2 years.
- The Loan Estimate must be retained for 3 years after the later of the date of consummation, the date disclosures are required to be made, or the date the action is required to be taken.
- The Closing Disclosure and all associated documents must be retained for 5 years after consummation.
Error Resolution and Tolerance Cures
- Policy:
[Company Name]is committed to accurate disclosures. If a tolerance violation or disclosure error is discovered, prompt corrective action will be taken. - Implementation Details: If amounts paid by the consumer exceed applicable tolerance thresholds, the violation must be cured by refunding the excess amount to the borrower within 60 days of consummation. Corrected disclosures must be provided concurrently as required by Regulation Z.
Escalation and Non-Compliance
- Policy: Strict adherence to TILA and Regulation Z is mandatory. Any employee who identifies a potential or actual violation of this policy must immediately escalate the issue to the Compliance Department. Failure to comply with this policy may result in disciplinary action, up to and including termination of employment.
